1. Agreement to these terms
These Terms & Conditions ("Terms") govern access to and use of Safetify, an EHS (Environment, Health & Safety) software platform comprising a mobile field-worker application, a web-based tenant dashboard, and related services (together, the "Service"), provided by Devtine (Pvt) Ltd ("Devtine," "we," "us," or "our"). By creating an account, accessing, or using the Service, you and the organization you represent ("Customer," "you") agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
Safetify helps field-operations businesses manage workplace safety: pre-task checklists, hazard and incident reporting, permit-to-work and job safety analysis (JSA) approvals, corrective-action tracking, certification/training records, and AI-assisted summarization, classification, and risk scoring built on Customer's own safety data. The Service is provided on a multi-tenant basis, with each Customer's data logically isolated from other customers.
3. Accounts and access
Customer is responsible for all activity under its tenant account, including accounts created for its employees, contractors, and field workers (each an "Authorized User"). Customer must ensure Authorized Users keep login credentials, PINs, and device-bound access confidential, and must promptly notify Devtine of any suspected unauthorized access, lost device, or offboarded worker requiring access revocation. Devtine may suspend access that we reasonably believe poses a security risk to the Service or other customers.
4. Customer data and content
Customer retains all rights to the data it and its Authorized Users submit through the Service, including checklist responses, hazard/incident reports, photos, voice recordings, GPS location data, and personnel records ("Customer Data"). Customer grants Devtine a limited license to host, process, and display Customer Data solely to provide, maintain, secure, and improve the Service, including to operate the AI features described in Section 5. Customer represents that it has the necessary rights and consents (including from its workers) to submit Customer Data to the Service.
5. AI-assisted features
Safetify uses AI/LLM-based features to draft incident and hazard summaries, suggest severity classifications, detect compliance gaps, and compile digests. AI-generated output is provided as a draft for human review — it is surfaced in the product as editable and requires an explicit confirmation step by a Customer user before being treated as final. Devtine does not warrant the accuracy or completeness of AI-generated content, and Customer remains responsible for verifying safety-critical determinations before acting on them.
6. Acceptable use
Customer will not, and will ensure Authorized Users do not: (a) use the Service to store or transmit unlawful content or content infringing third-party rights; (b) attempt to gain unauthorized access to the Service, other tenants' data, or underlying infrastructure; (c) reverse-engineer or attempt to extract source code from the Service except as permitted by law; (d) use the Service in a way that endangers worker safety by circumventing required safety workflows (for example, falsifying checklist completions); or (e) resell or provide the Service to third parties without Devtine's written consent.
7. Fees and payment
Fees are set out in the applicable order form or quote agreed between Customer and Devtine, typically priced per active field-worker account per month, plus any agreed one-time onboarding fee. Fees are quoted and invoiced in the currency specified in that order form or quote. Unless stated otherwise, fees are non-refundable and are due within the payment terms stated on the invoice. Late payment may result in suspension of the Service after reasonable notice.
8. Data retention and deletion
Devtine retains Customer Data for the duration of the subscription to preserve Customer's compliance and audit record. Upon termination, Devtine will make Customer Data available for export for a reasonable period and will delete or anonymize it thereafter in accordance with our data retention practices, except where retention is required by law. 9. Availability and support
Devtine will use commercially reasonable efforts to keep the Service available and to respond to support requests, but the Service is provided without warranty of uninterrupted or error-free operation. Scheduled maintenance will be communicated where practical. The mobile field-worker app is designed to operate offline and will continue to function for safety-critical capture workflows during connectivity outages, syncing once a connection is restored.
10. Disclaimer of warranties
The Service, including any AI-generated content, is provided "as is" and "as available." Safetify is a tool to support Customer's safety management program; it does not replace Customer's own compliance obligations under applicable occupational safety and health laws, nor does it constitute legal, engineering, or safety-professional advice. To the maximum extent permitted by law, Devtine disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, Devtine's aggregate liability arising out of or relating to these Terms or the Service will not exceed the fees paid by Customer for the Service in the twelve (12) months preceding the claim, and Devtine will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, even if advised of the possibility of such damages.
12. Termination
Either party may terminate the subscription in accordance with the applicable order form. Devtine may suspend or terminate access immediately for material breach of these Terms, including non-payment or misuse that compromises the security of the Service or other customers' data.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated to Customer via the Service or by email before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles, and any disputes will be subject to the exclusive jurisdiction of the courts of Islamabad, Pakistan, unless otherwise agreed in writing.
